Conditions for taking part in MX-Academy events

Participation in an MX-Academy event is subject to acceptance of these “General Terms and Conditions” and to signing a “declaration of consent and waiver” on the day of the event, by which the participant in particular waives any claims for damages.

Participant’s duty of care

The organiser’s instructions must be followed at all times. This also applies to the organiser’s representatives and helpers. Every participant must behave in such a way that others are neither obstructed nor endangered. The motorcycle may only be ridden by the registered participant. This is not a race! Failure to follow instructions, disruption of the event, etc., whether accidental or deliberate, entitles the organiser to exclude the participant immediately, completely or for a limited time. In this case the participant is not entitled to a refund of the participation fee. A participant who endangers the life and health of other participants through risky, reckless riding will be excluded from the training.

Exclusion of liability

The participants (riders, vehicle owners and keepers) take part in the event at their own risk. By signing the waiver, all participants waive any claims for damages against the organiser, the sponsors, the track owner, the appointed course leader and his representatives and helpers for all personal injury, property damage or other damage suffered in connection with the event.

The organiser, its representatives and helpers are not obliged to take out insurance for the event.

A motorcycle is provided to the participant for the event.

Although at least one instructor is present at the event, a certain risk of accident remains. The participant understands and knows all the dangers and risks involved in motorsport and accepts responsibility for his or her behaviour and for any resulting injuries suffered by the participant or by third parties. Any liability of the organiser for the consequences of accidents (damage to clothing, etc., bodily injury, disability, death and property damage) is excluded to the extent permitted by law.

By registering and signing the waiver, the participant confirms that he or she bears this risk personally and is adequately insured. If there is any uncertainty about the existence or scope of insurance cover, the organiser recommends that the participant consult an insurance adviser in advance.

Should a participant be injured during the event, he or she consents to any necessary medical treatment, rescue, and transport to hospital or other emergency facilities.

All these measures are taken by the organiser in good faith and according to its assessment of the participant’s condition. The participant undertakes to bear all related costs insofar as they are not covered by accident insurance or other insurance.

Material damage

MX-Academy covers the costs of normal wear and tear. The participant must pay for damage caused through his or her fault, such as falls, etc., that goes beyond normal wear and tear. The participant is responsible for ensuring that the equipment is in perfect condition at the time it is handed over. Pre-existing defects must be reported and recorded in writing. The participant is personally responsible for damage to his or her own equipment. Damage to rental equipment is repaired with original spare parts at a normal workshop hourly rate.

Terms of payment, vouchers

Vouchers are valid for 24 months from the date of issue, and their redemption must be declared when registering. All vouchers must be handed in when checking in for the event; otherwise the event must be paid for in cash on site. Unpaid vouchers are not accepted, and the event must then also be paid for in cash.

Data protection

Photographs and recordings taken during the participant’s riding instruction may be used, published and passed on by MX-Academy for its own advertising purposes. They entitle MX Academy to store and use the participant’s personal data and to pass it on to third parties commissioned with data processing in connection with the event who are bound to strict confidentiality. Furthermore, MX Academy may use the recordings and the data for the development of new products and services.

Cancellation

If you are unable to attend, you must cancel your participation 10 days in advance. In the event of late cancellation (including in the case of accident, illness, etc.), the following participation fees are due:

  • For cancellations less than 7 days before the event, 100% of the participation fee is due
  • For cancellations less than 10 days before the event, 50% of the participation fee is due
  • Vouchers are devalued in accordance with these cancellation conditions; for a new registration, the difference must be paid

Applicable law, place of jurisdiction

All rights, obligations and claims in connection with this event are subject to Swiss law. The exclusive place of jurisdiction is the registered office of MX-Academy AG. However, MX-Academy AG is also entitled to bring proceedings before any other competent court.
